These Terms of Service govern your purchase and use of products provided by CapacityLab.
By purchasing a product from CapacityLab, you agree to these Terms.
1. Products
CapacityLab provides fixed-scope digital performance risk reports for SaaS products, web applications, APIs, and online services.
The main product is a digital report that may include performance observations, capacity assumptions, possible bottlenecks, infrastructure considerations, cloud cost considerations, and prioritized technical recommendations.
2. Digital delivery
Products are delivered digitally. Delivery may depend on the customer providing the necessary technical context, documentation, links, metrics, screenshots, architecture information, or other relevant materials.
If the customer does not provide sufficient information, the quality, depth, and accuracy of the report may be limited.
3. No guarantee of production behavior
CapacityLab provides technical analysis and recommendations based on the information available at the time of review.
CapacityLab does not guarantee uptime, production behavior, revenue outcomes, incident prevention, scalability, availability, security, or business results.
The customer remains responsible for all engineering, infrastructure, operational, deployment, and business decisions.
4. Customer responsibilities
The customer is responsible for providing accurate, complete, and lawful information.
The customer must not provide confidential information, credentials, secrets, private keys, production passwords, or sensitive personal data unless explicitly requested and handled through an agreed secure process.
5. Scope limitations
Unless explicitly agreed in writing, the purchase does not include implementation work, production access, code changes, infrastructure changes, incident response, managed monitoring, on-call support, or guaranteed remediation.
Any additional work may require a separate agreement.
6. Payment
Payment is required before delivery begins unless otherwise agreed.
Prices are displayed on the pricing page or checkout page. Taxes may be added depending on the customer's location and the payment provider's tax handling.
7. Intellectual property
The customer retains ownership of their materials, systems, code, data, and business information.
CapacityLab retains ownership of its templates, methods, report formats, internal tools, analysis processes, and know-how.
The customer receives a right to use the delivered report internally for business, planning, engineering, and decision-making purposes.
8. Limitation of liability
To the maximum extent permitted by law, CapacityLab is not liable for indirect, incidental, special, consequential, or business losses, including lost profits, lost revenue, downtime, data loss, production incidents, or reputational harm.
CapacityLab's total liability for any claim is limited to the amount paid by the customer for the purchased product.
9. Changes to these terms
CapacityLab may update these Terms of Service from time to time. The latest version will be available on this page.
