These Terms of Service govern your use of products and services provided under the CapacityLab brand. By creating an account, subscribing to a plan or confirming a Run, you agree to these Terms. The Privacy Policy, the Refund & Cancellation Policy and, for customers who connect their own systems, the Data Processing Agreement form part of them.
1. The service
CapacityLab helps customers define and run bounded load tests against applications they are authorized to test. The service follows this sequence: Methodology revision → TestGoal revision → LaunchPlan → Confirm → Run → Decision.
A LaunchPlan fixes the selected target, allowed requests, load bounds, evidence obligations and the exact price of the Run in US dollars. Confirming it creates the Run. After execution and evidence finalization, CapacityLab records a Decision as attained, not attained or inconclusive.
2. Accounts and authority
You are responsible for activity under your account and for keeping account access and API tokens secure. If you act for a company or other organization, you confirm that you have authority to accept these Terms for it.
You may test only systems you own or are expressly authorized to test. You are responsible for selecting the correct target, permitted paths, methods, request bodies, load bounds and test window, and for obtaining any third-party authorization that is required.
3. Customer information and credentials
You must provide accurate and lawful information. Do not send passwords, private keys, production credentials, secrets or unnecessary personal data through support, public forms or any channel not explicitly designated for secrets.
You are responsible for reviewing the immutable LaunchPlan before Confirm. A changed target, expired plan or different scope requires a new plan and review.
4. Plans and automatic renewal
CapacityLab is sold as a monthly subscription in US dollars — Starter, Team or Scale — at the price shown on the Pricing page when you subscribe. Each plan includes a monthly budget for Runs and the limits listed on that page.
Your plan renews automatically each month, and the charge recurs on the same day of each month until you cancel. You can cancel at any time online, from Settings → Billing in the console or through the billing portal link in any receipt. Cancellation takes effect at the end of the period already paid for; access and the remaining included budget continue until then. Included budget is not money: it does not roll over, is not paid out and cannot be transferred. CapacityLab gives at least 30 days' notice by email before a price change takes effect on renewal.
5. Run pricing and payment
Each LaunchPlan contains an immutable price in US dollars. To start a Run, you must expressly accept that exact price at Confirm; CapacityLab then deducts it from the month's included budget as part of creating the Run. Reviewing or creating a LaunchPlan alone costs nothing. When the included budget is used up, Runs cannot be confirmed until the next period or an upgrade — there is no metered overage.
Payments are processed by Polar Software, Inc. ("Polar"), which acts as merchant of record and authorized reseller of CapacityLab plans: Polar is the party that sells you the plan, collects payment and applicable taxes, and issues the receipt, and Polar's checkout shows the final amount and the renewal terms before you pay. CapacityLab does not store complete payment-card details.
6. Digital delivery
Your plan is active in the account associated with the purchase as soon as payment is confirmed. A confirmed Run is delivered digitally through the CapacityLab service. Delivery may include a queued execution period, bounded load generation, execution evidence, a Run record and a Decision.
The Decision and evidence reflect only the target, scope, conditions and information available for that Run. Missing or unverifiable evidence may result in an inconclusive Decision.
7. Refunds, cancellation and stopping a Run
Refund eligibility for plan charges, duplicate or accidental payments, and Run charges is set out in the Refund & Cancellation Policy, which includes a 14-day refund window on a first charge.
You may choose not to Confirm a LaunchPlan. After Confirm, stopping a Run does not by itself determine refund eligibility; the platform's verified traffic record governs whether the Run's price is retained or returned to the included budget.
8. Service limitations
CapacityLab does not guarantee uptime, future production behavior, revenue, incident prevention, scalability, security or business results. Results from a bounded test may not predict behavior outside the tested conditions.
You remain responsible for engineering, infrastructure, deployment, operational and business decisions, and for ensuring that a test will not breach your agreements or harm third parties.
9. Intellectual property
You retain ownership of your systems, code, data and materials. CapacityLab retains ownership of its software, methods, templates, schemas, analysis processes and know-how.
Subject to these Terms, you may use the Run records, evidence and Decisions delivered to your account for your internal engineering, operational and business purposes.
10. Acceptable use
You must not use CapacityLab to test a target without authorization, evade access controls, disrupt third parties, introduce malicious payloads, probe unrelated systems, or violate applicable law. CapacityLab may refuse or stop work that appears unsafe, unlawful or outside the confirmed scope.
11. Limitation of liability
To the maximum extent permitted by law, CapacityLab is not liable for indirect, incidental, special, consequential or business losses, including lost profits, lost revenue, downtime, data loss, production incidents or reputational harm.
To the maximum extent permitted by law, CapacityLab's total liability for a claim is limited to the amount paid for the plan in the twelve months preceding the claim.
12. Changes to these Terms
CapacityLab may update these Terms from time to time. The latest version and its update date will remain available on this page. Changes do not rewrite the price or scope of a LaunchPlan already confirmed.
13. Supplier information
The service is offered under the CapacityLab brand at capacitylab.dev by _legal entity and registered address — to be completed by the owner_.
